Ann Arbor BJJ Free Trial

RELEASE OF LIABILITY - READ CAREFULLY - THIS AFFECTS YOUR LEGAL RIGHTS

In exchange for participation in the activity of Brazilian Jiu Jitsu organized by Ann Arbor BJJ, of 525 Suite B East Liberty Street, Ann Arbor, MI 48104 and/or use of the property, facilities and services of Ann Arbor BJJ, I agree for myself and (if applicable) for the members of my family, to the following:

AGREEMENT TO FOLLOW DIRECTIONS. I agree to observe and obey all posted rules and warnings, and further agree to follow any oral instructions or directions given by Ann Arbor BJJ, or the employees, representatives or agents of Ann Arbor BJJ.

ASSUMPTION OF THE RISKS AND RELEASE. I recognize that there are certain inherent risks associated with the above described activity and I assume full responsibility for personal injury to myself and (if applicable) my family members, and further release and discharge Ann Arbor BJJ for injury, loss or damage arising out of my or my family's use of or presence upon the facilities of Ann Arbor BJJ, whether caused by the fault of myself, my family, Ann Arbor BJJ or other third parties.

INDEMNIFICATION. I agree to indemnify and defend Ann Arbor BJJ against all claims, causes of action, damages, judgments, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from my or my family's use of or presence upon the facilities of Ann Arbor BJJ.

FEES. I agree to pay for all damages to the facilities of Ann Arbor BJJ caused by any negligent, reckless, or willful actions by me or my family.

CONSENT. I, (person signing below) of address that is on file, consent to the participation of my son/daughter, in the activity of Brazilian Jiu Jitsu, and agree on behalf of the above minor to all of the terms and conditions of this Agreement. By signing this Release of Liability, I represent that I have legal authority over and custody of (name signed up).

MEDICAL AUTHORIZATION. In the event of an injury to the above minor during the above described activities, I give my permission to Ann Arbor BJJ or to the employees, representatives or agents of Ann Arbor BJJ to arrange for all necessary medical treatment for which I shall be financially responsible. This temporary authority will begin on the date signed and will remain in effect until terminated in writing by the undersigned or when the above described activities are completed. Ann Arbor BJJ shall have the following powers:

The power to seek appropriate medical treatment or attention on behalf of my child as may be required by the circumstances, including without limitation, that of a licensed medical physician and/or a hospital; The power to authorize medical treatment or medical procedures in an emergency situation; and The power to make appropriate decisions regarding clothing, bodily nourishment and shelter.

APPLICABLE LAW. Any legal or equitable claim that may arise from participation in the above shall be resolved under State of Michigan law.

NO DURESS. I agree and acknowledge that I am under no pressure or duress to sign this Agreement and that I have been given a reasonable opportunity to review it before signing. I further agree and acknowledge that I am free to have my own legal counsel review this Agreement if I so desire. I further agree and acknowledge that Ann Arbor BJJ has offered to refund any fees I have paid to use its facilities if I choose not to sign this Agreement.

ARM'S LENGTH AGREEMENT. This Agreement and each of its terms are the product of an arm's length negotiation between the Parties. In the event any ambiguity is found to exist in the interpretation of this Agreement, or any of its provisions, the Parties, and each of them, explicitly reject the application of any legal or equitable rule of interpretation which would lead to a construction either "for" or "against" a particular party based upon their status as the drafter of a specific term, language, or provision giving rise to such ambiguity.

ENFORCEABILITY. The invalidity or unenforceability of any provision of this Agreement, whether standing alone or as applied to a particular occurrence or circumstance, shall not affect the validity or enforceability of any other provision of this Agreement or of any other applications of such provision, as the case may be, and such invalid or unenforceable provision shall be deemed not to be a part of this Agreement.

DISPUTE RESOLUTION. The parties will attempt to resolve any dispute arising out of or relating to this Agreement through friendly negotiations amongst the parties. If the matter is not resolved by negotiation, the parties will resolve the dispute using the below Alternative Dispute Resolution (ADR) procedure.

Any controversies or disputes arising out of or relating to this Agreement will be resolved by binding arbitration under the rules of the American Arbitration Association. The arbitrator's award will be final, and any judgment may be entered upon it by any court having proper jurisdiction.

EMERGENCY CONTACT. In case of an emergency, please call person on file.

I HAVE READ THIS DOCUMENT AND UNDERSTAND IT. I FURTHER UNDERSTAND THAT BY SIGNING THIS RELEASE, I VOLUNTARILY SURRENDER CERTAIN LEGAL RIGHTS.

Ann Arbor BJJ Free Trial Agreement
This Trial Agreement (the “Agreement”) is entered into between Ann Arbor BJJ  (“the Gym”) and the undersigned individual (“Trial”). By signing this Agreement, the Trial agrees to the terms and conditions below.

1. Eligibility

1.1 The 3-day free trial is available only to first-time visitors of Ann Arbor BJJ.
1.2 You must be a current Michigan resident to be eligible. A valid ID may be requested to verify residency.
1.3 Alternatively, if you attend a college in Ann Arbor or a surrounding city (within approximately a 1-hour drive), you are also eligible for the 3-day free trial. Student ID may be requested as proof of enrollment.

2. Trial Period

2.1 The free trial is valid for three (3) consecutive days , beginning on the date of your first attended class.
2.2 During this period, you may attend as many age-appropriate classes as you’d like, based on our current class schedule.

3. Conduct and Expectations

3.1 Trial members are expected to follow all gym policies, dress codes, and class rules.
3.2 Failure to follow gym rules or any inappropriate behavior may result in immediate termination of the trial period at the discretion of Ann Arbor BJJ staff.

3.3 Prohibited Behaviors

The following behaviors are strictly prohibited:

• Disrespecting or talking down to other members or staff.
  
  

• Slamming, punching, kicking, or eye-gouging.
  
  

• Unsportsmanlike conduct (e.g., excessive celebration, taunting, hostility).
  
  

• Intentional injury attempts (e.g., cranking submissions with excessive force or continuing after a tap).
  
  

• Disregarding hygiene standards (e.g., untrimmed nails, dirty gear, poor hygiene).
  
  

• Failure to follow instructor directions (e.g., ignoring instruction, disrupting class, refusing to train safely).
  
  

• Harassment or bullying of any kind.
  
  

3.4 Parent Conduct (if applicable)

• Parents may observe class but must remain in designated viewing areas.
  
  

• Parents may not coach, provide instruction, or interrupt classes.
  
  

• Distractions (e.g., signaling to the child, calling them over) must be avoided.
  
  

• Concerns should be addressed before or after class, not during.
  
  

• If a child is allowed to attend adult class times, parents understand that adult language and music may be present.
  
  

3.5 Additional Kid Rules

• Kids must be able to follow basic instructions and behave respectfully.
  
  

• Kids aged 10 and older may attend adult night classes only with a suitable training partner who meets the same criteria.
  
  

4. Property Damage

4.1 Trial participants are financially responsible for any damage they intentionally or negligently cause to Gym property, including but not limited to mats, walls, fixtures, and equipment.

5. Photographic and Video Release

5.1 Permission to Record: The Trial grants Ann Arbor BJJ the right to photograph and record video during classes, events, and other Gym activities.
5.2 Use of Media: The Gym may use these images and recordings for promotional purposes (e.g., social media, website, app, advertising).
5.3 Opt-Out Option: To opt out of media usage, the Trial must notify the Gym in writing before participating in any activities.

6. Communication and Updates

6.1 The Gym may contact Trials via text message or email to share updates, event reminders, and important class information.
6.2 Trials are responsible for keeping their contact information up-to-date.
6.3 Opt-Out Option: To opt out of communications, Trials must notify the Gym in writing by emailing info@annarborbjj.com .

7. Right to Amend

7.1 Ann Arbor BJJ reserves the right to amend its policies, procedures, and this Agreement at any time.
7.2 Trials will be notified of any changes in writing.

8. Acceptance and Acknowledgment

By signing below, the Trial confirms that they meet the eligibility requirements and agree to abide by all terms outlined in this Agreement. The Trial also acknowledges that a separate liability waiver is required and must be signed prior to participating in any class.

You are in no way, shape, or form required to sign up as a member before, during, or after this trial. Although, after this trial, we have no doubt you’ll see why so many people have chosen to join this awesome community!
